These general terms and conditions apply to all bookings, reservations and services of Maratopia Tours, especially for excursions, nature tours, boat tours, kayaking tours, horseback riding tours, visits to the Maratopia garden and combined tour offers in Costa Rica.
By booking a tour, the guest accepts these general terms and conditions.

2. Services of Maratopia Tours
Maratopia Tours offers guided excursions and nature experiences in the Puerto Limón region and surroundings. These include tours with nature watching, boat trip, kayaking, national park visits, suspension bridges, zipline, horseback riding tours, cultural stops and visiting Maratopia.
The exact scope of services results from the respective tour description on the website or from the individual booking confirmation.
Changes in the process may be necessary if weather, road conditions, official requirements, safety reasons, delays in ships or other circumstances make this necessary.
3. Booking and Conclusion of Contract
A booking can be made via the website, via inquiry form, by e-mail, WhatsApp or via partner platforms.
The contract is concluded as soon as Maratopia Tours has confirmed the booking in writing, for example by e-mail or WhatsApp.
In the case of bookings via external platforms such as GetYourGuide, Viator, shore excursions or other providers, the conditions of the respective platform also apply.
4. Prices and Payment
All prices are given in the respective tour description. Unless otherwise stated, the prices are in US dollars.
Since Maratopia Tours usually does not require a deposit, payment is made on the day of the tour or according to the individually agreed payment conditions, unless otherwise agreed.
Depending on the type of booking, payment can be made in cash, by payment link, by bank transfer, via online payment or via an external booking platform.
Personal expenses, tips, additional food and drinks, special requests and services not expressly listed in the tour description are not included in the price.
5. Meeting point, pick-up and punctuality
For cruise guests, the pick-up is Port of Puerto Limon. The meeting point is right at the port exit behind the turnstile, on the street side.
Since the exact arrival and exit time of a cruise ship can be slightly shifted, we plan our tours flexibly depending on the actual arrival of the ship. For pick-up at the port, therefore, is usually a Time window of about 30 minutes provided.
Our guests are asked to come to the agreed meeting point after leaving the ship and pay attention to the guide of Maratopia Tours.
For guests starting directly from Maratopia, the meeting point is in Maratopia’s guarded parking lot.
We ask that you at the latest Within 20 minutes to be on site after the agreed time so that the tour can be carried out as planned. If there is a delay, we ask for a short message via WhatsApp or telephone.
Maratopia Tours plans cruise guests excursions in such a way that a timely return to the ship is possible. However, unforeseeable events such as road closures, accidents, extreme weather conditions or official measures outside of our sphere of influence cannot be completely ruled out.
6. Guest Cancellation
Since Maratopia Tours usually does not require a down payment, the guest will not incur any refunds if the cancellation is made in good time.
The guest is asked to take a booked tour at least 24 hours before the start of the tour to cancel in writing (e.g. by e-mail or WhatsApp). A timely cancellation will help Maratopia Tours plan guides, vehicles, partners and available places.
In the event of cancellation less than 24 hours before the start of the tour or no show without prior notice, Maratopia Tours reserves the right to refuse future bookings or only accept them against advance payment.
If an advance payment or payment has been made via an external booking platform in individual cases, the cancellation conditions specified there apply.
7. Cancellation by Maratopia Tours
Maratopia Tours can cancel or postpone a tour if there are important reasons. These include in particular:
Extreme weather conditions
security risks
official orders
Illness or failure of guides
Technical problems
natural events or force majeure
Since Maratopia Tours usually does not require a down payment, Maratopia Tours usually does not claim a refund.
If a payment has already been made in individual cases, Maratopia Tours will either offer an alternative date, an alternative tour or a refund if we have canceled the cancellation and no deviating conditions of an external booking platform apply.
8. Changes to the tour schedule
Maratopia Tours is entitled to adjust the course of a tour if necessary for safety, weather, nature, traffic or organizational reasons.
Since many tours are nature experiences, Animal observations or sightings of certain species are not guaranteed. Animals live freely and do not appear to order.
A modified process does not automatically entitle you to a price reduction if the essential character of the tour is retained.
9. Guest Responsibility
The guest picks up own responsibility Participate in the tour and undertake to follow the instructions of the guides.
The guest is responsible for being able to take part in the booked tour. This is especially true for activities such as kayak, zipline, suspension bridges, horseback riding, longer walks or tours in a tropical climate.
The guest should bring suitable clothing, sturdy shoes, sun protection and rain protection, insect protection and sufficient water.
People who are under the influence of alcohol or drugs or endanger the safety of the tour can be excluded from participation. In this case, there is no entitlement to compensation.
10. Children and minors
Children and young people may only participate if accompanied by an adult or with the express consent of a legal guardian.
parents or escorts are responsible for your children throughout the tour.
Age, size, weight, or health restrictions may apply to certain activities. These will be communicated in the respective tour description.
11. Safety and Nature
Maratopia Tours attaches great importance to safety, respect for nature and responsible handling of animals and plants.
The Feeding, touching, tracking or disturbing wild animals is strictly forbidden. It is also forbidden to take plants, animals, stones or other natural components with you from protected areas.
The guest undertakes not to leave any garbage in nature.
12. Liability
Maratopia Tours is liable within the framework of the statutory provisions for damage caused by intentional or grossly negligent behavior by Maratopia Tours or its employees.
Maratopia Tours assumes damage, loss or injury caused by the guest’s own misconduct, non-compliance with safety instructions, health restrictions, animals, weather, traffic, third-party providers or force majeure. no liability, to the extent permitted by law.
The guest is responsible for personal belongings (cash, cameras, mobile phones, valuables).
13. Third Party Services
Some tour components can be carried out by external partners, for example boat operators, zipline providers, equestrian companies, national parks or transport service providers.
Third-party services also apply their security rules and conditions. Maratopia Tours carefully selects Partners, but is not liable for circumstances beyond their own sphere of influence.
14. Weather, Natural Events and Force Majeure
Costa Rica is a tropical country. Rain, high humidity, heat, short-term weather changes, road damage and natural events can affect the course of a tour.
Light or normal rain is no reason for a rejection. The tour will take place if it can be carried out safely.
In the event of force majeure, natural disasters, official measures, strikes or accidents outside the sphere of influence of Maratopia Tours, there is no entitlement to damages.
15. Cruise Guests and Ship Delays
For cruise guests, the tour schedule depends on the ship’s idle time. Maratopia Tours plans the tours in such a way that a timely return to the port is guaranteed.
If the ship is late or if the lying plan changes, Maratopia Tours tries to adjust the tour. If the tour cannot take place due to a significant ship delay or a non-hauled port call, a fair solution will be offered if possible.
Since no deposit is usually required, there is usually no claim for a refund in such cases.
16. Health Instructions
The guest is asked to inform Maratopia Tours about relevant health restrictions before the start of the tour, insofar as they are important for safe participation.
These include, for example, cardiovascular problems, severe allergies, mobility restrictions, pregnancy or breathing problems. Maratopia Tours may refuse to participate if there are significant concerns for safety reasons.
17. Privacy
Maratopia Tours processes personal data exclusively for processing inquiries, bookings, payments, communication and execution of the booked services.
This may include name, email address, phone number, number of participants, tour date and pick-up location. Further information can be found in the data protection declaration on the website.
18. Complaints and Complaints
If there is a problem during the tour, please ask the guest to Notify immediately of the Guide or Maratopia Toursso that a solution can be found directly.
Subsequent complaints must be submitted in writing and in a comprehensible manner. Maratopia Tours strives for a fair and factual clarification.
19. Language
These terms and conditions can be provided in German, English and Spanish. In the event of ambiguities or deviations between the language versions, the version used when booking is valid, if legally permissible.
20. Applicable Law and Jurisdiction
The right of Republic of Costa Ricaunless there are no mandatory consumer protection regulations. Jurisdiction is, to the extent permitted by law, the competent place of jurisdiction in Costa Rica.
21. Severability Clause
If a provision of these general terms and conditions is invalid in whole or in part, the effectiveness of the remaining provisions remains unaffected. Instead of the invalid provision, a regulation that comes as close as possible to the economic and legal purpose of the original provision applies.
