Terms and Conditions

1. Scope

These Terms and Conditions apply to direct inquiries, reservations and tours provided by Maratopia Sociedad de Responsabilidad Limitada, trading under the Maratopia Tours brand.

Different terms apply only when expressly confirmed in text form.

2. Inquiry and reservation

An inquiry submitted through the website, by email or WhatsApp is initially non-binding. A reservation is formed only when Maratopia expressly confirms availability and the guest accepts the offered reservation.

Automatic acknowledgements of receipt are not reservation confirmations.

3. Scope of services

The confirmed tour description, number of participants, language, meeting point, start time and price are decisive.

Minor operational changes remain possible where necessary and where the overall character of the tour is preserved.

4. Prices and payment

No deposit is required. Payment is made in cash on site before the tour unless expressly agreed otherwise.

Bookings made through external platforms may also be subject to their payment and contract terms.

5. Cruise ships

If the cruise ship does not call at Puerto Limón, no costs arise for a tour reserved directly with Maratopia.

Start time and itinerary are adapted to actual disembarkation and port time. Maratopia does not provide an unrestricted return guarantee for events beyond its control, but plans the tour carefully around the confirmed port time.

6. Changes and cancellations by guests

Changes or cancellations should be communicated as early as possible. In the event of a last-minute no-show, Maratopia may charge documented and unavoidable third-party costs where legally permitted.

7. Weather, nature and force majeure

Tropical weather and rain are natural conditions in Costa Rica and do not automatically lead to cancellation.

In the event of safety risks, natural events, official measures, road closures or other force majeure, Maratopia may adjust or cancel the itinerary, route or start time.

8. Wildlife sightings

Animals live freely in their natural environment. Sightings of particular species, numbers, proximity or duration cannot be guaranteed.

9. Participation and safety

Participants must follow instructions from guides and partners and disclose relevant health or mobility limitations in advance.

Maratopia may refuse or end participation for objective safety reasons.

10. External service partners

Individual services may be provided by carefully selected transport, boat, zipline, hanging bridge, national park or other local partners. Their safety and operating rules must be observed.

11. Liability and insurance

Liability is governed by applicable law. Liability for intent, gross negligence, death, personal injury or damage to health is not excluded.

Maratopia Sociedad de Responsabilidad Limitada maintains valid public liability insurance with Instituto Nacional de Seguros (INS).

12. Privacy

Personal data is processed in accordance with the Privacy Policy.

13. Complaints

Issues should be reported during the tour where possible so that a prompt solution can be considered. Later complaints should be submitted in a clear written form to info@maratopia.com.

14. Language versions

These terms are available in German, English and Spanish. In case of interpretation differences, the German version prevails unless mandatory law requires otherwise.

15. Governing law and jurisdiction

The law of the Republic of Costa Rica applies, subject to mandatory consumer protection rules. Exclusive jurisdiction agreements apply only where legally permitted.

16. Final provisions

If any provision is wholly or partly invalid, the remaining provisions remain unaffected. The statutory rule applies in place of the invalid provision.
